1. Definitions and Interpretation
In these Terms & Conditions, unless the context otherwise requires:

- "You", "Your", "Client", "Hirer" refers to the person or organisation renting equipment from us
- "Equipment" means all audio, video, lighting, and accessories rented or purchased from us
- "Rental Period" means the duration from collection/delivery to return of equipment
- "Daily Rate" means the rental charge for each 24-hour period
- "Security Deposit" means the refundable amount held against damage or loss
- "Website" refers to https://impipbalca.pro and all associated pages

3. Acceptance of Terms
By accessing our website, requesting quotes, booking equipment, or using our services, you agree to comply with and be bound by these Terms & Conditions, along with our Privacy Policy and Refund Policy.
If you do not agree with any part of these terms, you must not use our services. We reserve the right to refuse service to anyone for any lawful reason.
4. Equipment Rental Process
4.1 Booking and Confirmation
- All equipment bookings are subject to availability
- Quotes provided are valid for 14 days unless otherwise stated
- Bookings are confirmed upon receipt of deposit payment and signed rental agreement
- We reserve the right to decline bookings at our discretion
- Confirmed bookings receive written confirmation via email within 24 hours
4.2 Rental Period Calculation
- Rental periods are calculated in 24-hour increments from collection/delivery time
- Weekend rates apply for Friday collection with Monday return (3-day minimum)
- Weekly rates require 7-day minimum rental period
- Monthly rates require 28-day minimum rental period
- Late returns incur additional daily charges at standard rates
4.3 Collection and Delivery
- Equipment can be collected from our facility during business hours (Monday-Friday 09:00-18:00)
- Delivery services available across the UK for additional fees
- Delivery times are estimates and not guaranteed
- You must inspect equipment upon collection/delivery and report any issues immediately
- Photographic ID and proof of address required for collection
5. Pricing and Payment
5.1 Rental Charges
- All prices quoted are in British Pounds Sterling (GBP)
- Prices are subject to VAT at the current UK rate (20%)
- We reserve the right to amend prices with 30 days' notice
- Price changes do not affect existing confirmed bookings
5.2 Payment Terms
- 50% deposit required at booking confirmation
- Balance payment due 48 hours before collection/delivery
- Security deposit required before equipment release (typically 20-50% of equipment value)
- Accepted payment methods: bank transfer, credit/debit cards, business accounts
- Cash payments over £500 require advance notice
5.3 Security Deposit
- Security deposits held for damage, loss, or late return costs
- Refunded within 5-7 business days after satisfactory equipment return
- Deductions itemised and communicated via email
- Disputed deductions handled according to Section 13
5.4 Late Payment
- Late payment interest charged at 4% above Bank of England base rate
- Collection costs recoverable from client
- Equipment not released without full payment
6. Client Responsibilities
6.1 Age and Capacity
- You must be at least 18 years old to rent equipment
- You confirm you have legal capacity to enter into binding contracts
- Corporate clients confirm authority to bind the organisation
6.2 Equipment Care
You agree to:
- Use equipment only for lawful purposes and as designed
- Handle equipment with reasonable care and skill
- Protect equipment from theft, damage, and adverse weather
- Not modify, repair, or tamper with equipment
- Store equipment securely when not in use
- Comply with manufacturer operating instructions
- Keep equipment in your possession (no sub-letting)
6.3 Prohibited Uses
You must NOT:
- Use equipment for illegal activities or purposes
- Sub-rent or lend equipment to third parties
- Remove equipment from the UK without written permission
- Use equipment in hazardous environments without appropriate protection
- Exceed equipment specifications or capacity limits
- Use equipment whilst intoxicated or impaired
7. Equipment Condition and Testing
- All equipment tested before rental and provided in working condition
- You must test equipment immediately upon collection/delivery
- Defects must be reported within 2 hours of collection/delivery
- Replacement equipment provided for confirmed defects (subject to availability)
- Normal wear and tear accepted; damage beyond reasonable use chargeable
8. Loss, Damage, and Liability
8.1 Your Liability
You are responsible for equipment throughout the rental period and liable for:
- Loss or theft of equipment (full replacement value)
- Damage beyond normal wear and tear (repair or replacement costs)
- Missing accessories, cases, or components
- Cleaning costs for excessively dirty equipment
8.2 Insurance
- Equipment insurance available at additional cost
- Insurance covers accidental damage (excess applies)
- Theft covered only with police crime reference number
- Negligence, intentional damage, and prohibited uses not covered
- Clients may use own insurance (proof required)
8.3 Limitation of Our Liability
We are not liable for:
- Indirect, consequential, or special damages
- Loss of profits, revenue, data, or opportunities
- Costs exceeding total rental fees paid
- Equipment failure due to misuse or external factors
- Compatibility issues with client's other equipment
Nothing in these terms excludes liability for death/injury caused by negligence, fraud, or other non-excludable liabilities under UK law.
9. Cancellations and Changes
9.1 Client Cancellations
- More than 14 days before rental: Full refund minus 10% administration fee
- 7-14 days before rental: 50% refund of total booking value
- Less than 7 days before rental: No refund (full charges apply)
- Cancellations must be submitted in writing via email
9.2 Company Cancellations
- We reserve the right to cancel bookings due to equipment unavailability, safety concerns, or force majeure
- Full refund provided for company-initiated cancellations
- Alternative equipment offered where possible
- No liability for consequential losses from cancellations
9.3 Booking Modifications
- Changes subject to equipment availability
- Requests must be made at least 48 hours in advance
- Additional charges apply for upgraded equipment
- Refunds processed for downgrades (subject to 10% admin fee)
10. Returns and Late Returns
- Equipment must be returned by agreed date/time
- Late returns charged at full daily rate per 24-hour period
- Equipment must be returned in original condition with all accessories
- Returns must be during business hours unless alternative arrangements made
- Collection service available for returns (charges apply)
- Failure to return equipment may result in police notification
11. Force Majeure
We are not liable for failure to perform obligations due to circumstances beyond reasonable control, including:
- Natural disasters, severe weather, flooding
- War, terrorism, civil unrest
- Government restrictions or regulations
- Labour disputes, strikes
- Supplier failures, transportation disruptions
- Pandemics or public health emergencies
Rental periods may be extended without charge during force majeure events affecting equipment return.
12. Intellectual Property
- All website content, logos, and materials remain our property
- You may not reproduce, distribute, or modify our content without written permission
- Equipment rental does not transfer ownership or intellectual property rights
- You retain ownership of content created using our equipment
13. Dispute Resolution
- Disputes should first be addressed through direct communication with our team
- Formal complaints handled within 14 business days
- Unresolved disputes may be referred to mediation
- Legal proceedings subject to jurisdiction of England and Wales courts
14. Data Protection
Your personal information is processed according to our Privacy Policy and UK GDPR requirements. We collect, store, and use your data solely for rental administration, communication, and legal compliance.
15. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
16. Amendments to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of modified terms. Existing bookings remain subject to terms accepted at booking time.
17. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
18. Entire Agreement
These Terms & Conditions, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Impipbalca Pro regarding equipment rental services, superseding all prior agreements and understandings.
